In most cases, the amount of the tax debt the taxpayer has to pay in an Offer in Compromise is only a small fraction of the total amount owed. In order for the IRS to grant an Offer in Compromise, at least one of the following conditions must apply:

  • You must prove you are not liable for the debt
  • You must prove you will be never be able to pay the full amount of the debt
  • You can prove that collection of the debt would create an undue economic hardship (if you are elderly or disabled, for instance)
